Consumer Protection

Consumer Protection

When a product causes harm or a company misleads buyers, the consequences can disrupt your health, livelihood, and peace of mind. At Ferraro Law, we advocate for individuals and families in product liability and consumer protection cases involving defective products, hidden dangers, or corporate misconduct. Whether your case involves a hazardous household item, mislabeled medication, or a lack of proper safety warnings, we work to hold manufacturers and sellers accountable. Our focus is on making sure you’re heard—and on helping you move forward.
Understanding Consumer Protection Cases

Understanding Consumer Protection Cases

Consumer protection law exists to keep companies from putting unsafe or unfair products into the hands of the public. While the term can sound broad, these cases often involve product liability claims—where a product’s design flaw, manufacturing defect, or missing safety warnings cause serious harm. In other instances, they involve deceptive marketing, false labeling, or hidden health risks.

For example, a company may fail to disclose that a cleaning product contains hazardous chemicals, or a toy might lack appropriate safety instructions. In other cases, consumers may be harmed by defective medical devices or dangerous prescription drugs that were rushed to market without adequate testing. These failures can lead to injury, illness, or worse. Consumer protection laws are designed to hold companies accountable and create a clear path to justice when something goes wrong.

What We Handle

What We Handle

Our consumer protection practice includes a wide range of product liability matters. These are some of the most common case types we investigate:

Toxic or Hazardous Products

We handle claims involving products that contain dangerous substances not properly disclosed to consumers—such as asbestos in talcum powder or harmful chemicals in cosmetics and cleaning products. These cases often involve serious health consequences and a lack of transparency from manufacturers.

Defective Designs

Some products are inherently unsafe due to flawed design, even when used as intended. We investigate whether poor design played a role in causing harm—such as in pelvic mesh devices or unstable electronic products.

Manufacturing Defects

When a product is properly designed but something goes wrong during production, it can result in injuries or long-term harm. This includes situations like malfunctioning auto components or faulty medical devices that don’t meet quality control standards.

Failure to Warn

Companies have a responsibility to provide adequate safety warnings and usage instructions. When warnings are missing, unclear, or misleading, it puts consumers at unnecessary risk. We take on cases involving products sold without the information people need to use them safely.

Each of these issues can lead to serious injury or financial loss. Our job is to determine what went wrong—and to seek appropriate compensation for our clients.

Deciding Whether to Hire a Consumer Protection Attorney

Deciding Whether to Hire a Consumer Protection Lawyer

It’s not always easy to tell whether you need an attorney. But consumer protection and product liability cases can be complex. They often involve technical investigations, strict legal deadlines, and corporate legal teams defending their product.

If you’ve suffered harm—physical, financial, or otherwise—after using a product or relying on its labeling or advertising, talking with an experienced attorney is a good first step. We can help you understand whether your case qualifies, what the process might look like, and how to proceed in a way that protects your rights.

Consumer Protection Violations: Compensation for Victims

Consumer Protection:
Compensation for Victims

When unsafe products or deceptive business practices cause harm, the impact can go far beyond the initial injury or incident. You may be eligible to recover compensation for both the immediate and long-term consequences.

Compensation may cover:

Medical Costs

This includes hospital bills, surgeries, prescription medications, rehabilitation, and any ongoing care needed due to injuries or illnesses caused by the product.

Lost Wages or Future Earnings

If your injuries prevent you from working—temporarily or permanently—you may be compensated for lost income, missed job opportunities, or diminished future earning potential.

Pain and Suffering

Compensation may also cover non-economic losses, such as chronic pain, emotional distress, reduced quality of life, or trauma related to the injury or experience.

If a dangerous product contributed to the death of a loved one, surviving family members may be entitled to damages for funeral costs, loss of companionship, and financial support.

Punitive Damages

In some cases, courts may award punitive damages to hold companies accountable for egregious misconduct—such as knowingly selling defective or dangerous products.

What to Look for in a Consumer Protection Attorney

What to Look for in a Consumer Protection Attorney

Selecting the right consumer protection attorney can have a major impact on your case. As you evaluate your options, make sure to look for:

Experience with Complex Claims

Choose an attorney who regularly handles consumer protection and product liability matters. Whether your case involves defective products, misleading financial practices, or fraudulent advertising, relevant experience ensures your legal team understands the applicable statutes and how to build a strong claim.

Personalized Legal Support

Your case is unique—and your representation should be too. Look for attorneys who take the time to understand your circumstances, explain your rights clearly, and develop a tailored strategy aligned with your goals.

Access to Expert Resources

Consumer protection cases often involve technical details, from product design flaws to financial misconduct. The right attorney should have access to expert witnesses, investigators, and specialists to help strengthen your case and prove liability.

Nationwide Capability

Even if your issue started locally, large corporations operate across state lines. A law firm with national reach is better positioned to handle multi-jurisdictional issues, coordinate filings, and pursue your claim wherever needed.

Results-Driven Fee Structure

A contingency fee arrangement means your attorney only gets paid if you do. This aligns their interests with yours—encouraging a focused, results-oriented approach that prioritizes your recovery.

Commitment to Communication

You should never be left in the dark about your own case. Look for attorneys who maintain clear, ongoing communication—keeping you informed at each stage, answering your questions, and helping you feel confident about the legal process.

SUZANNE

ASBESTOS & MESOTHELIOMA

It has been 12 years since my father passed away. Every time this anniversary comes, it always overwhelms me with a mixture of emotions. On one side, just like most people, I start to reminisce about the great times we had as a family and how I miss it so much. On the other side, I can’t help but remember the pain and suffering he endured the last several months of his life. I believe closure sits right in the middle of these emotions. Closure is always hard when someone you love passes away. To us, closure felt unattainable. It was hard because we did not understand why he was taken from us so soon. Collectively as a family we felt that he never needed to suffer the way that he did. When I start to think about closure, part of me thinks about James Ferraro Jr. and The Ferraro Law Firm. My mother found the law firm while my father was still alive. She had inquired about possibly finding out, and holding accountable, those individuals and/or companies that had contributed to my father’s illness. They went to work for my mother immediately and inevitably helped her find a little piece of closure that she so desperately needed following his death. As I have always said, no amount of money could ever replace my father. However, because of the tireless work of James Jr. and the rest of the firm, my mother was able to move forward with her life. She moved forward knowing she would be okay, our family would be okay, and that those responsible were held accountable. Fast-forward to today and I still think about James Jr. and the firm during this anniversary. I cannot stress enough the amount of appreciation my family and I have for them and what they did for us.

It has been 12 years since my father passed away. Every time this anniversary comes.

Just a short note to thank you for all you have done for us, especially for my husband. He had a lot of respect for you and we thank you for your caring ways towards him, not only as your client, but as a person. It will always be appreciated and remembered.

Responsiveness, Quality, Professionalism, Value: From the first meeting we had at Ferraro Law with the lawyer Jose Luis Becerra, myself and my husband, we were treated with great kindness, efficiency and disposition and he clarified our doubts regarding my rights. I was consulted for lung cancer (Mesothelioma) caused by exposure to asbestos. The advice was successful, achieving positive results in the corresponding claims. We are satisfied with the treatment and results obtained. Special thanks to attorney Jose Luis Becerra and the Ferraro Law firm.

The Steps Your Attorney Will Take

The Steps Your Attorney Will Take

Once you decide to hire a consumer protection attorney, they will guide you through a clear, step-by-step process:

1

Initial Consultation

Our team begins with a free consultation to learn how the product caused harm. We review documents such as medical records, product packaging, and purchase information to identify potential safety issues or misleading claims.

2

Investigation & Evidence Gathering

We investigate how the product failed—through design flaws, manufacturing errors, or missing warnings—and consider whether consumer protection laws apply due to inaccurate marketing or labeling.

3

Claim Preparation & Filing

Our attorneys prepare the legal filings based on the facts of your case. Claims may involve defective product theories, failure to warn, or violations of consumer disclosure standards.

4

Negotiation & Settlement Talks

We often explore resolution through negotiation, focusing on outcomes that reflect the physical, financial, and personal impact of the product failure or unfair practice.

5

Trial Preparation (If Needed)

If a settlement isn’t reached, our team prepares for trial by organizing evidence, working with experts, and presenting how the product defect affected your health or well-being.

6

Ongoing Support

Even after your case ends, we stay available to discuss related concerns, answer questions, or help if new product safety or consumer issues arise.

Design Defect

A problem with the product’s original design that makes it inherently unsafe, even when used correctly. This means every unit of the product is dangerous because it was designed without proper safety considerations.

Manufacturing Defect

An error that occurs during the production or assembly of a product, causing it to differ from its intended design. This can make just a few units dangerous, rather than the entire product line.

Failure to Warn

When a manufacturer does not provide adequate instructions or warnings about potential risks, making it difficult or impossible for users to avoid harm even if they follow directions.

Strict Liability

A legal principle that allows injured consumers to seek compensation without needing to prove the company was negligent—only that the product was defective and caused harm.

Consumer Fraud

A business practice where a company misrepresents a product, hides known risks, or provides false or misleading information to encourage consumers to make a purchase.

Contingency Fee

A type of payment arrangement where the attorney only gets paid if you win your case or receive a settlement. This allows clients to pursue legal action without paying upfront legal fees.
