The Town of West Tisbury and Oak Bluffs, Massachusetts have chosen The Ferraro Law Firm to represent them in multidistrict litigation suits concerning the widespread use of PFAS-containing firefighting foam which has led to contamination of soil and groundwater in many areas, leading to public health concerns.
PFAS are a group of chemicals that have been used in various products for many years, including firefighting foam (AFFF), which can resist water, oil, and heat. However, studies have shown that PFAS can leach into groundwater, contaminate soil, and persist in the environment for a long time. These substances are also bio accumulative, meaning that they accumulate in the bodies of animals and humans over time, posing significant risks to human health.
One of the most significant risks associated with PFAS is their potential to cause cancer. Studies have found that exposure to PFAS increases the risk of testicular and kidney cancer. Additionally, PFAS exposure has been linked to reproductive and developmental disorders, immune system dysfunction, and liver damage.
AFFF containing PFAS has been widely used for many years, particularly in fighting fires involving flammable liquids such as gasoline or jet fuel. Although PFAS-containing AFFF is effective in extinguishing these fires, it poses significant risks to human health and the environment. The widespread use of PFAS-containing firefighting foam has led to contamination of soil and groundwater in many areas, leading to public health concerns.

West Tisbury’s involvement in the lawsuit was decided when a state report was released in January 2023 that named the West Tisbury fire department as the source of “imminently hazardous” levels of PFAS in local, private water wells. Firefighting foam was listed as the main cause.
When asked about the case by The MV Times, a news source local to West Tisbury, Attorney James Ferraro, Jr. stated, “The town bears zero responsibility for this issue. The blame lies squarely with the manufacturers and distributors of PFAS-containing AFFF.”
The Ferraro Law Firm is no stranger to environmental toxic torts such as AFFF. The firm’s team of dedicated and skilled attorneys have devoted their careers to fighting for justice on behalf of individuals and families who have suffered harm due to exposure to harmful chemicals and environmental hazards. Many members of the firm have witnessed first-hand the devastating impact that toxic exposure can have on a person’s health, finances, and overall well-being, and the firm has dedicated its practice to holding responsible parties accountable for their negligent actions.
In terms of the South Carolina MDL lawsuit, a bellwether trial involving Stuart, Florida, is set to take place in June.
“Depending on the outcome of that case, settlement discussions could come to fruition in late 2023 or 2024. We are going to seek a recovery that compensates West Tisbury for past and future costs related to the remediation of the affected wells… plus all other costs associated with their PFAS contamination response efforts,” Ferraro reported to The MV Times.

Frequently Asked Questions
Frequently Asked Questions
01.
How did PFAS chemicals end up in municipal drinking water?
For decades, AFFF firefighting foam containing PFAS was used at military bases, airports, fire training sites, and industrial facilities. The chemicals in AFFF do not break down naturally, seeping into groundwater and contaminating public water systems. Many municipalities are now discovering widespread PFAS contamination in their drinking water supplies due to years of unregulated chemical use.
02.
Who is responsible for the cost of PFAS remediation?
Chemical manufacturers, not municipalities, should bear the financial burden of PFAS cleanup. Companies like 3M and DuPont profited from selling AFFF despite knowing the risks associated with its PFAS content. Municipalities now facing cleanup costs can pursue legal action to hold these corporations accountable and recover compensation for water treatment and remediation efforts.
03.
What are the health risks associated with PFAS exposure?
PFAS exposure creates significant challenges for municipal public water systems. The contamination drives up the costs of water testing, treatment, and remediation, placing an additional financial and regulatory burden on local governments as they strive to secure safe drinking water.
04.
How can my municipality qualify for settlement funds?
If your city, county, or public water system has detected PFAS contamination in drinking water sources, you may be eligible for compensation under the $13.5 billion 3M & DuPont settlement or through separate litigation against other chemical manufacturers. Ferraro Law will assess your case and determine the best legal pathway to secure the funds your community needs.
05.
Can Ferraro Law represent municipalities outside of Florida?
Yes. Ferraro Law represents municipalities and public water systems nationwide in AFFF litigation and PFAS-related legal claims. Our firm has extensive experience handling large-scale environmental contamination lawsuits across the country.

Not too long ago I picked up the phone and called the Ferraro Law Firm not quite knowing what to expect. From the moment I reached out, the team made me feel heard and taken care of — not just like another case walking through the door.
Nikki Hurtado was my first primary contact. After speaking with her I knew that I had picked the right firm. She walked me through the process in plain understandable language. Even after numerous calls, she never made me feel like I was asking too many questions, and I always felt confident that my case was in expert hands.
My litigator was Daniel Di Matteo. If there was ever anyone that you would want by your side in a court of law, it would be him. He was everything that you would want in an attorney—calm, cool, always prepared, communicative and most importantly–experienced. He knew everything that was going to happen before it occurred but was prepared for any contingency. He is a fantastic attorney.
What really set them apart was their communication. I was kept informed at every stage — no chasing down updates, no wondering what was happening with my case. Calls and emails were returned promptly, and they proactively reached out whenever there was a development.
The professionalism of the entire team — from the attorneys to the support staff — was exceptional. Everyone I interacted with was kind, compassionate, and genuinely invested in my well-being, not just the outcome of my case.
And the outcome? Better than I could have hoped for. They fought hard on my behalf and secured a result that truly reflected the impact this injury had on my life.
You could ask for no better firm or attorney.
